இந்தியா குழந்தைகளை விபசாரத்தில் ஈடுபடுத்தும் மையமாக மாறியுள்ளதுபுது : “குழந்தைகளை அதிக அளவில் விபசாரத்தில் ஈடுபடுத்தும் மையமாக, இந்தியா மாறியுள்ளது. இந்த பயங்கர அபாயத்தை ஒழிக்க, சிறப்பு புலனாய்வுக் குழுக்களை அமைக்க வேண்டும்’ என, மத்திய அரசுக்கு சுப்ரீம் கோர்ட் உத்தரவிட்டுள்ளது. பச்சாபன் பச்சோ அந்தோலன் என்ற அரசு சார்பற்ற அமைப்பு, சுப்ரீம் கோர்ட்டில் மனு ஒன்றைத் தாக்கல் செய்தது.
இது சம்பந்தமான குற்றங்கள்: இந்த மனுவை விசாரித்த நீதிபதிகள் தல்வீர் பண்டாரி மற்றும் பட்நாயக் ஆகியோர் அடங்கிய பெஞ்ச் பிறப்பித்த உத்தரவு விவரம் வருமாறு: குழந்தைகளை விபசாரத்தில் ஈடுபடுத்துவதும், அது தொடர் பான மோசடிகளும் அதிகரித்துள் ளன. இதுபோன்ற குற்றங்கள் அபாயகரமானவை. இந்த குற்றங் களை ஒழிக்க, சிறப்பு புலனாய்வு குழுக்களை அமைக்க வேண்டும். இந்த யோசனையை பரிசீலிக்கும் படி, கூடுதல் சொலிசிட்டர் ஜெனரல் அவர்கள், மத்திய அரசை கேட்டுக் கொள்ள வேண்டும்.
காரணங்களைக் காட்டித் தப்பித்துக் கொள்ள முடியாது: நாட்டில் நிலவும் வறுமையாலும், பெரிய அளவிலான வேலை இல்லா திண்டாட்டத்தினாலும், குழந்தைகள் விபசாரம் நடக்கிறது. இதனால், நமது மதிப்புமிக்க கலாசாரம் சீரழிந்து விடுகிறது. இதுபோன்ற மோசமான நடவடிக்கைகளின் மையமாக இந்தியா மாறிக் கொண்டிருக் கிறது. குழந்தைகளை விபசாரத்தில் ஈடுபடுத்துவோருக்கு எதிராக, இந்திய தண்டனைச் சட்டத்தின் 376வது பிரிவை பயன்படுத்துவது பற்றி, அரசு பரிசீலிக்க வேண்டும்.
உலகமயமாக்கலுக்காக குழந்தைகளை பலிகடாக்களாக்க முடியாது: நாடு உலகமயமாக்கம் மற்றும் தாராளமயமாக்கம் சகாப்தத்தில் உள்ளது. இந்த சூழ்நிலையில் செக்ஸ் நோக்கங்களுக்கு சிறிய குழந்தைகள் தவறாகப் பயன்படுத்தப்படுவதை அரசு கண்டு கொள்ளாமல் இருப்பது சரியல்ல. இந்த அபாயகரமான பிரச்னையை தீர்ப்பதில், அரசு அதிக முக்கியத்துவம் கொடுக்க வேண்டும். இவ்வாறு நீதிபதிகள் தங்கள் உத்தரவில் தெரிவித்தனர்.

‘India becoming hub for child prostitution’

NEW DELHI: Expressing apprehension that India could soon have the dubious distinction of being a hub of child prostitution, Supreme Court on Friday urged the Centre to weigh the need for creation of a special police force to tackle the problem.
A Bench comprising Justices Dalveer Bhandari and A K Patnaik appeared to have gone through solicitor general Gopal Subramaniam’s report on a mechanism to secure the rights of children. The SG had identified poverty and lack of employment as two major reasons for children being trafficked and pushed into prostitution.
Toughening its stand, the Bench said the time had come for courts to deny bail to those accused of trafficking children and pushing them into prostitution. These observations came during a hearing on a PIL filed by NGO Bachpan Bachao Andolan.
It also wanted to know from the SG why sex workers were facing prosecution and harassment at the hands of law enforcing agencies, but not those exploiting the children. Could rape charges be not slapped against those exploiting child prostitutes, it asked.
The SG had suggested making village panchayats a key instrument in tracking children and mooted the idea of maintaining a list of children suspected to have been trafficked for sex exploitation or as labourers, child beggars or street vendors. This list must be given to the nearest police station for registration of cases to trace them and bring them back to families, he had said.
Touching on the problems faced by children trafficked from across the border into India, the SG’s action plan suggested that “children from neighbouring countries such as Nepal and Bangladesh found in trafficking or working as child labourers shall be first sent to juvenile homes for care and protection through child welfare committees and their embassies must be contacted to make arrangement for repatriation”.
In an earlier report, the SG had informed the SC that “about 200 girls and women enter prostitution daily of which 20% are below 15 years of age”. “Research on cross-border trafficking has indicated that 5,000-7,000 Nepali girls are trafficked into Indian annually. This research also highlighted that in the last decade, the average age of the trafficked girl has steadily fallen from 14-16 years to 10-14 years,” he had said.

Fearing that India might emerge as the “hub of child sex abuse”, the Supreme Court on Friday asked the government to deal sternly with criminals and recommended a separate police wing to deal with child trafficking.
“India is now becoming a hub of child sex abuse,” observed a bench of Justices Dalveer Bhandari and AK Patnaik.
The court was hearing a 2006 lawsuit by civil society group Bachpan Bachao Andolan that sought implementation of the various provisions of the Juvenile Justice Act, 2000, and other legislations for the welfare of children and sex workers.
“The most serious problem is the use of children for sex trade. While this crime is growing, hardly any case is registered. If a case is registered, it will have a deterrent effect,” the bench observed, while asking Solicitor General Gopal Subramanium to seek the government’s clear stand and roadmap for fighting the malady.
“Apart from the criminals being prosecuted, it will have a deterrent effect, which will make a lot of difference,” the bench observed.
Asking the government to deal sternly with those using children in sex trade, the bench advised it to have a separate police wing to probe the matter.
“The government needs to understand clearly that child trafficking is the priority area. There are several aspects. There should be a special investigative agency to deal with trafficking and plug the loopholes,” the bench said.
Listing out some of the problematic aspects in child and women trafficking, the bench said: “The problem area for inter-state trafficking is Nepal, North East, Bangladesh border. There should be a special agency to deal with it, where the present police is virtually ineffective.”
The bench also advised the government to seek the help of NGOs in tackling the problem of child and women trafficking.
“You should involve NGOs also that will help you (the government).”
Lamenting the plight of sex workers, the bench said: “See the condition of sex workers, whenever the police conducts raid, only they are arrested and traffickers get away scot free and no legal aid is available to them.”
The bench also expressed concern over sex workers being forced to continue with their profession despite being HIV positive and spreading the deadly disease in the process.
“Most of the sex workers are HIV positive and are continuing with their profession. They will only multiply disease. Steps must be taken to curb this,” the bench said.
